1. Acceptance of Terms

By accessing or using the Pristine Partner service ("Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service. These Terms constitute a legally binding agreement between you and Pristine Partner Inc. ("we," "us," or "our").

2. Service Description

Pristine Partner provides a managed AI voice receptionist service for small businesses in the United States. The Service includes:

  • An AI voice receptionist that answers inbound calls on behalf of your business
  • Smart questioning and caller information collection
  • Email delivery of call messages and summaries
  • Scheduled outbound summary calls at your preferred times
  • Priority-based call sorting and classification
  • Industry-specific business templates
  • A customer dashboard for billing and account management

The Service is available exclusively in the United States. By using the Service, you confirm that you are located in the United States.

3. Account Responsibilities

To use the Service, you must create an account by providing accurate and complete information including your name, company name, email address, and phone number. You are responsible for:

  • Maintaining the accuracy of your account information
  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account
  • Ensuring your use of the Service complies with all applicable laws

We are not liable for any loss arising from unauthorized use of your account.

4. Acceptable Use Policy

You agree not to use the Service to:

  • Violate any applicable local, state, national, or international law or regulation
  • Engage in fraudulent, deceptive, or misleading practices
  • Harass, abuse, or harm another person or entity
  • Transmit unsolicited commercial communications (spam)
  • Interfere with or disrupt the Service or servers connected to the Service
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal telemarketing or robocalling activities
  • Misrepresent the AI receptionist as a human operator to callers in jurisdictions where such disclosure is required
  • Use the Service to collect information from callers for unlawful purposes
  • Resell or redistribute the Service without our written consent

We reserve the right to suspend or terminate your account for violation of these acceptable use terms without prior notice.

5. Payment Terms

By subscribing to the Service, you agree to the following pricing:

  • Local Number Plan: $3.00 per month for a dedicated local phone number.
  • Toll-Free Number Plan: $7.00 per month for a dedicated 888 toll-free number.
  • Usage Rate: $0.18 per minute of voice service usage (inbound and outbound calls), billed monthly.
  • Starter Fee: A one-time payment of $0.99 to activate your account.

Payment is processed through Stripe. You authorize us to charge your payment method for all fees incurred. Usage is billed monthly based on actual minutes consumed. Call duration is rounded up to the nearest minute for billing purposes.

We reserve the right to modify pricing with 30 days advance notice. Continued use of the Service after a price change constitutes acceptance of the new pricing.

6. Call Recording Disclosure

All calls handled by Pristine Partner are recorded and transcribed to provide the service. By using the Service, you consent to this recording. You are responsible for ensuring compliance with applicable call recording laws in your jurisdiction, including providing any required disclosures to callers.

Call recordings and transcripts are retained for 90 days and are accessible through your dashboard. You may request earlier deletion by contacting support.

7. Service Availability

We strive to maintain the Service available 24 hours a day, 7 days a week. However, we do not guarantee 100% uptime. The Service is provided on a best-effort basis and may be temporarily unavailable due to:

  • Scheduled maintenance (with advance notice when possible)
  • Unscheduled maintenance or emergency repairs
  • Third-party service outages
  • Circumstances beyond our reasonable control

We are not liable for any damages resulting from Service interruptions or downtime.

8. Limitation of Liability

To the maximum extent permitted by law, Pristine Partner Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising from your use of or inability to use the Service.

Our total liability for any claims arising from or related to the Service shall not exceed the total amount you paid to us in the twelve (12) months preceding the claim.

We do not guarantee the accuracy or completeness of information collected by the AI receptionist during calls. You acknowledge that AI-generated transcriptions and summaries may contain errors.

9. Indemnification

You agree to indemnify, defend, and hold harmless Pristine Partner Inc. and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any rights of a third party
  • Your failure to comply with applicable call recording or privacy laws
  • Any content or data you provide through the Service

10. Dispute Resolution

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) in accordance with its Commercial Arbitration Rules.

The arbitration shall take place in San Francisco, California. The arbitrator's decision shall be final and binding. Judgment on the award may be entered in any court having jurisdiction.

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. For any matters not subject to arbitration, the exclusive jurisdiction shall be the state or federal courts located in San Francisco, California.

You agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action.

11. Termination

You may cancel your subscription at any time through your customer dashboard. Upon cancellation:

  • You will receive a confirmation email with a cancellation link that must be clicked to confirm.
  • Your service will continue until the end of your current billing period.
  • After the billing period ends, your AI receptionist will be deactivated.
  • You will be billed for any usage incurred up to the cancellation effective date.

We may terminate or suspend your account immediately, without prior notice, if you breach these Terms or engage in prohibited activities. Upon termination, your right to use the Service ceases immediately.

12. Intellectual Property

The Service, including all content, features, functionality, software, and technology, is owned by Pristine Partner Inc. and is protected by United States and international copyright, trademark, patent, and other intellectual property laws.

You retain ownership of all content and data you provide to the Service (business information, call scripts, knowledge base content). You grant us a limited, non-exclusive license to use this content solely for the purpose of providing the Service to you.

You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse engineer or attempt to extract the source code of the Service.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will provide notice of material changes by posting the updated Terms on this page and updating the "Last Updated" date. For significant changes, we will also notify you via email.

Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and cancel your account.

14. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure. We do not guarantee the accuracy or completeness of information collected by the AI receptionist during calls.

15. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your information. By using the Service, you consent to the data practices described in our Privacy Policy.
